Prescriber Terms of Use
These terms are the agreement between you and us when you use DukadawaRx to write prescriptions. They explain who can use the service, how your PIN works as your signature, your professional duties, fees and payouts, and what happens if something goes wrong. Please read them with our Privacy Policy.
About these terms
DukadawaRx is operated by Afya Intelligence, of Dar es Salaam, Tanzania. "We", "us" and "our" mean Afya Intelligence. "You" means the prescriber using DukadawaRx.
By creating an account and accepting these terms, you agree to them. If you do not agree, do not use DukadawaRx.
Your acceptance is an electronic record. Under the Electronic Transactions Act, 2015, it has the same effect as signing on paper.
Who can use DukadawaRx
You may use DukadawaRx to write prescriptions only if:
- you are registered with the professional council that regulates prescribers in your country, for example the Medical Council of Tanganyika in Tanzania;
- your licence to practise is valid and allows you to prescribe the medicines you prescribe;
- you practise in a country where we have opened sign-up;
- you are an adult and able to enter into a contract.
You must tell us at once if your registration or licence is suspended, restricted, cancelled or expires.
Verification
When you register, you give us your registration number, licence details, registration certificate, practising licence and photo ID. We check them, including against the council's register. You cannot issue prescriptions until we approve your account.
We may ask for more documents at any time. We may refuse, suspend or cancel your account if we cannot verify you, if your licence expires, or if we have good reason to believe the details are false.
Your account and PIN
You sign in with your phone number and a one-time SMS code, and you set a 4-digit PIN.
Your PIN is your electronic signature. When you enter it to issue a prescription, you sign that prescription. The Electronic Transactions Act, 2015 gives electronic signatures legal effect. You are responsible for every prescription signed with your PIN.
You must:
- keep your PIN secret and never share it, even with colleagues or our staff;
- keep control of the phone number on your account;
- use shared-device mode on any computer others use, and sign out when you finish;
- tell us at once at support@afyarx.co.tz if you think someone else knows your PIN or has used your account.
After 5 wrong PIN entries, PIN use is locked for 15 minutes. You can reset your PIN with a new SMS code.
Your professional responsibility
DukadawaRx is a tool for writing and sending prescriptions. It does not practise medicine.
- All clinical decisions are yours: diagnosis, choice of medicine, dose, duration and advice to the patient.
- The checks, warnings and calculated quantities the app shows are aids. They are not medical advice, and they do not catch every problem. You must use your own professional judgement.
- You must follow the law and the rules of your council on prescribing, including standard treatment guidelines where they apply.
- You must not prescribe controlled medicines, such as narcotic or psychotropic medicines, through DukadawaRx. The app blocks medicines listed as controlled, but you remain responsible for not prescribing them here.
- You must only prescribe for patients you have assessed in a way your professional rules allow.
Patient data and notice
You must enter patient details accurately, including the phone number that will receive the pickup code. Check the number with the patient or caretaker before you issue.
You must tell each patient, or their caretaker, that their prescription is created and sent through DukadawaRx; that the pharmacy, the facility the prescription is issued under, and their insurer if they use insurance, will see it; and where to find our Privacy Policy. Where the law requires the patient's consent, you must get it.
Use patient data only to care for the patient and as these terms allow.
Clinical notes
You may add a clinical note to a prescription. The note stays private to you. We do not show it to organisations, insurers, pharmacies or patients.
Do not put in the note anything that should be on the prescription itself, such as instructions the pharmacy or patient needs.
Consultation fees and platform fee
You set your consultation fee within the range allowed for your country. A new fee or a change needs our approval. If you issue under a hospital or clinic that has set a fee range, the fee is moved into that range, and the app shows the fee that will apply before you issue.
Patients can pay the fee by mobile money through DukadawaRx or in cash, or you can waive it.
For each consultation fee paid through DukadawaRx, we keep a platform fee. It is a percentage of the consultation fee, set by us. The current percentage is shown in the app. We do not take a platform fee on fees paid in cash or waived.
We may change the platform fee percentage. We will tell you at least 30 days before a change takes effect. The change applies only to fees paid after that date.
Wallet and payouts
A consultation fee paid through DukadawaRx, less the platform fee, is held as pending in your wallet. It becomes available when the prescription is closed: dispensed, partly dispensed, cancelled or expired.
You can withdraw your available balance to a mobile money number you control. You must verify the number with an SMS code first. A minimum withdrawal amount applies and is shown in the app.
Payouts are made through our payment provider and the mobile money operator. We are not responsible for delays or failures caused by them, but we will help you follow up.
If a payment is reversed, refunded or found to be made in error or by fraud, we may deduct it from your wallet.
Hospitals and clinics
You can link your profile to the hospitals and clinics where you work, and choose one as your default. Prescriptions are issued under your default.
If a hospital or clinic has an account with us, it can confirm or remove your link, and it can set a minimum and maximum consultation fee. You cannot issue under a link that is waiting for confirmation or has been removed. The hospital or clinic can see prescriptions issued under it, but not your clinical notes.
Only link to places where you actually work.
Insured patients
When you enter an insurer and membership number, we may check it with the insurer. If the check fails, you can still issue, and the prescription is marked as cover not verified. The insurer decides on cover and payment in its own systems.
Public profile
Your profile is private by default. You can choose to make it public in the directory. Only verified prescribers with a valid licence can be public.
A public profile shows the details listed in our Privacy Policy, including your photo, name, registration number and an area rounded to about 1 km. It never shows your phone number or exact location. You can make your profile private again at any time.
Anything you write in your introduction must be true and must follow your council's rules on advertising.
Acceptable use
You must not:
- let anyone else use your account or PIN;
- enter false patient details or issue a prescription for a patient who does not exist;
- use DukadawaRx to get medicines for yourself or others outside proper care;
- use patient data for marketing or any purpose other than care;
- try to get around the app's checks, access data you are not allowed to see, or disrupt the service;
- copy, scrape or resell data from DukadawaRx;
- break any law or professional rule.
Suspension and termination
We may suspend or close your account, with notice where possible, if:
- your registration or licence is not valid;
- you break these terms or the law;
- we have good reason to believe your account is being misused or patients are at risk;
- a regulator or court requires it.
Where we can, we will tell you why and give you a chance to respond. You can close your account at any time by writing to support@afyarx.co.tz.
When your account is closed, you can no longer issue prescriptions. We will pay out your available balance, less any amounts you owe, to your verified number. We keep records as our Privacy Policy explains.
Availability
We work to keep DukadawaRx available and accurate, but we cannot promise it will always be available or free of errors. It depends on the internet, mobile networks, SMS and payment providers that we do not control.
We may change, pause or stop parts of the service. If we plan to stop the service entirely, we will give you reasonable notice.
Medicine prices, pharmacy stock and quotes come from pharmacies and may change. Exchange rate conversions are for reading only. Fees and payouts are always in your country's currency.
Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not allow us to limit.
Otherwise:
- we are not liable for clinical decisions you make, or for harm caused by wrong information you enter;
- we are not liable for indirect losses, such as loss of income or reputation, that were not reasonably foreseeable;
- our total liability to you in any 12 months is limited to the platform fees we received from you in that period, or TZS 1,000,000 if that is higher.
You are responsible for losses we suffer because you break these terms or the law, for example by misusing patient data.
Records and cooperation
Prescriptions you issue, and what happens to them, are kept as records for the periods our Privacy Policy sets out. You cannot delete an issued prescription, but you can cancel it while it has not been dispensed.
If a regulator, your council or a court asks us about prescriptions you issued, we may share the relevant records with them as the law requires. You must answer reasonable requests from us about prescriptions you issued, for example when we look into a complaint or suspected misuse.
Privacy
Our Privacy Policy explains how we use your data and the data of your patients. It forms part of these terms.
Governing law
These terms are governed by the laws of the United Republic of Tanzania.
Disputes
If you have a complaint or dispute, write to us at support@afyarx.co.tz. We will try to settle it by negotiation in good faith within 30 days.
If it is not settled, either of us may take it to the courts of Tanzania.
Changes to these terms
We may change these terms. We will tell you in the app or by SMS at least 30 days before an important change takes effect, unless the change is needed sooner by law or for safety.
We will ask you to accept the new terms. We record which version you accepted and when. If you do not accept, you can close your account.
